What Happens After Mediation

Ensuring clarity, continuity, and informed next steps beyond the mediation session

Mediation does not conclude abruptly at the end of a session. Attention is given to ensuring that participants leave with clarity about what has been discussed, what has been agreed, and what options remain available.

Potential Outcomes

Agreement Reached

Where agreement is reached, outcomes can be recorded in clear and practical language that may form the basis for a parenting agreement, court orders or other agreements. This may include a summary of understandings or agreed next steps, prepared in a manner that reflects the discussions and intentions of those involved.

Participants remain free to seek independent legal or professional advice before relying on or formalising any agreement.

Partial Resolution

In circumstances where matters are partially resolved, or where additional time is needed, follow-up options may be discussed.

This can include further mediation sessions, a period of reflection before continuing, or alternative ways of progressing the issues raised. The process remains flexible and responsive to the needs of those involved.

Alternative Pathways

If mediation is not suitable, or if it becomes clear that the matter would be better addressed through another pathway, Mark ensures that this is communicated openly and responsibly.

Where appropriate, participants may be provided with referrals to external professionals or services, such as legal advisers, counselling support, or other dispute resolution options.

The Post-Mediation Process

1

Documentation & Recording

Agreements or understandings reached during mediation are documented clearly and practically. This written record reflects the discussions and intentions of participants, providing a reference point for implementation and any necessary formalisation. Documentation is prepared in clear and understandable language that all parties can understand and rely upon.

2

Independent Advice

Participants are encouraged to seek independent legal or professional advice before finalising or acting on any agreement. This ensures that decisions are fully informed and that each party understands their rights, obligations, and the implications of any commitments made during mediation.

3

Follow-Up Options

Where matters require further discussion or reflection, follow-up sessions can be arranged. This flexibility allows participants to revisit issues, address new concerns, or build upon partial agreements already reached. The process adapts to the pace and circumstances of those involved.

4

Referrals & Support

When mediation is not suitable or when additional support is needed, appropriate referrals are provided. This may include recommendations for legal representation, counselling services, family support programs, or alternative dispute resolution pathways that better suit the circumstances.

Ready to Take the First Step?

Taking the first step does not require certainty or commitment. It simply involves opening a conversation and exploring whether mediation may provide a constructive way forward.
