What Happens Before Mediation

The first consultation is a private one-on-one session available at no cost and is designed to answer your questions and help us learn more about your history and current situation. It provides an opportunity to discuss the situation, understand how mediation may assist, and determine whether the process is appropriate for the circumstances.

Consultations are typically 30 minutes in length and conducted by Zoom or phone, allowing sufficient time to explore the issues without creating unnecessary pressure. The discussion is confidential and conducted in a professional setting that encourages openness and understanding.

There is no obligation to proceed beyond the initial no-cost consultation. The purpose of the consultation is not to persuade, but to inform. Mark's role is to listen carefully, explain the mediation process, and answer any questions so that participants can make an informed decision about next steps.

Is Mediation Right for My Situation?

Mediation is effective in many circumstances, but it is not appropriate for every situation. An honest assessment at the outset helps ensure that process is a good fit for the people and the circumstances.

Mediation may be appropriate if:

  • You are willing to engage in discussion in good faith
  • You are seeking practical, forward-focused outcomes
  • You would prefer a confidential and respectful process
  • You wish to retain control over decisions rather than have them imposed

Mediation may require careful consideration if:

  • Communication has completely broken down
  • There is a significant power imbalance that needs to be addressed
  • Emotions are particularly heightened and additional support may be required

Mediation may not be suitable at this time if:

  • One party is unwilling to participate voluntarily
  • Immediate legal intervention is required
  • Safety or serious risk issues are present
